Paul J McNulty Dear Mr. McNulty, On June 26, 2002 I made a criminal referral Exhibit 1 to you re: actions by Barbara Sindo and Donnie Marshall and Gail Randall in the DEA and Vicky Linder (and Tim Hill) in the CMS (Medicare fraud division) and Mark Stafford of the Kansas Board of Healing Arts (KBHA) and others…re: actions that I alleged, constituted obstruction of justice in US 202-CV192, my Free Speech/Due Process civil lawsuit. In that criminal referral, I presented timelines, internet news articles, court documents and telephone tape recordings that supported this thesis. Please see the Memorandum and Order in US 202-CV192 from the trial judge Raymond Jackson. Jackson refused to recuse himself, even after I pointed out to the Court, the corrupt pattern of specially selected Clinton appointed judges hearing yet another case involving, yet another, Clinton pal in trouble… As has been documented by Bloomquist, Rotunda, Seeper and a host of. other journalists. Exhibit 2. Poor old Jackson, caught between a rock and a hard place, simply went along with the Clintons’ dictates and summarily dismissed the case without hearing oral arguments.. Fortunately for Jackson, and unfortunately for our justice system, the three Bush, senior appointees on the US 4th Circuit, Paul Niemeyer, Micheal Luttig and Karen Williams, covered for Jackson by affirming Jackson’s decision via their opinion….”Affirmed by unpublished per curiam opinion” And “unpublished opinions are not binding precedent in this circuit. Conner, Clerk see pages 100-104 on enclosed 3½“ floppy..Exhibit 4…and pages 48-49 re; Clinton-Bush blackmail… ……… In this case, Seaboard Farms’ coconspirators were at BCBS of Kansas and at the Kansas Board of Healing Arts (KBHA) See www.stopseaboard.net. The unequivocal evidence re: obstruction of justice included the Vicky Linder telephone tape in which Linder, Kathy Hackerthorne and Kathy (Kraft) try to rationalize the four, five, and six year delays in investigating “patient overcharges” because of…“returned mail because of (my) changed address”. And all the fumbling around at the onset, trying to decide if Vicky Lender was really there at CMS that morning, etc. And then Clinton appointee Tim Hill (CMS) and staff precede to harass me, over the next two years, (June, 2002 to present) re: a four hundred dollar bogus Medicare “over charge” of patient NS ….operated by me eight years ago! If Mr. Hill and the “Integrity Section” (CMS) of Medicare want something to investigate something ….why not let them investigate those four tonsil and palatal deaths managed and/or covered up by their own reviewers Mark Bell and Kenneth Scheinberg. You, for reasons currently under investigation, failed to answer my referral. And failed to initiate any investigation of the Clintons’ pals in trouble at Seaboard Farms, as outlined in US 202-CV192. Exhibit 2 Related to their, alleged, major cocaine importation criminal enterprise (through Juarez and Laredo and other ports of entry). Nor the selective prosecutions of me by Seaboard’s narcopuppets. Since June 26, 2002, the KBHA, the DEA and the CMS (Medicare fraud division) have continued their selective prosecutions against me. Furthermore, I sent you court documents, newspaper articles, internet websites, tape recorded telephone conversations and timelines that all support the thesis that the Clintons’ pals at Seaboard Farms were indeed involved in a giant cocaine importation criminal enterprise, with both Bill and Hillary Clinton running active interference for Seaboard through the DEA, the DOJ and through the federal courts. On June 26, 2002, I told you that I, a (federal) whistleblower, was (and still is) being selectively prosecuted by Clinton puppets Tim Hill, Barbara Sindo and Gail Randall, who remain firmly entrenched in the federal bureaucracy. You failed to investigate same. Furthermore, to show their blatant hypocrisy, the DEA covers up Donnie Marshall’s conspiracy obstruction of justice in my Free Speech lawsuit….US202 CV 192 (see US02-1652 for details). The DEA denies me a show cause hearing re: my DEA license. Curiously, instead of providing me a show cause hearing, the DEA proceeds, alternatively, to smear my name across the internet . Just as the KBHA smeared my name across the Internet, on the National Practitioners Data Bank and on Questionable Doctors. For what purpose? However, the height of hypocrisy goes to the KBHA. The KBHA flagrantly denied me, during their kangaroo hearing, my Fourth, Fifth, and Sixth Amendment Rights – see US 02-1652. Exhibit 3 While simultaneously covering up the perioperative tonsil and palatal surgery deaths in those four young, otherwise healthy patients. Cases managed by and/or covered up by BCBS/Medicare/CMS/KBHA reviewers Mark Bell MD and Kenneth Scheinberg MD And covered up by KBHA (lawyers), Kelli Benintendi Lawerence Breuing and Mark Stafford and (investigator) Peter Massey. Exhibit:5. Let’s see if I’ve got this straight….I write a series of editorials criticizing the planned placement of 4 million hogs in western Kansas by Seaboard Farms. In advance of their pollution of the Smokey Hill and Kansas Rivers with nitrates and a variety of gram negative organisms and pathogenic viral particles, and the subsequent degeneration of all wildlife refugees and municipal water supplies downstream. I was stripped of all financial resources, as well as most of my civil rights. And, simultaneously, the above-mentioned transgressions were covered up. And the deaths of four young, otherwise healthy tonsil and palatal surgery patients. were covered-up. And numerous other cited medical transgressions were covered-up…see Dr. Scheinberg’s malpractice of pt MW Exhibit 8 And Dr. Sunderland’s malpractice in the management of patients M.K and JP. These cases, rather that being prosecuted…were instead covered up by BCBS of KS, KBHA, CMS, Medicare, the Kansas Attorney General’s office and by a variety of Clinton appointed federal bureaucrats. In violation of the AMA’s Principals of Medical Ethics, Numbers II and V. Exhibit 7 AMA Ethics Principals Ironically, I had simply been adhering to AMA Ethics Principal VII. “A physician shall recognize a responsibility to participate in activities contributing to the improvement of the community and betterment of the community and the betterment of public health…”e.g. expose of Seaboard’s nitrates, fecal coliform bacteria, cocaine trafficking and political corruption. Curiously, BCBS/Medicare/KBHA reviewers and “expert witnesses” Mark Quillen PhD, Paul Murphy MD, Kenneth Scheinberg MD, Elton Sunderland MD and Mark Maslan MD knew all too well about Seaboard Farms and it’s municipal water pollution and narcotrafficking, having extensively reviewed my two websites, www.stopseaboard.net and www.sleepapneaspecialists.com in preparation for their live and proffered (Sunderland ) testimony against me before the KBHA. In violation of the AMA ethics principals II and V. Repeat! KBHA “expert witnesses”Mark Quillen, Paul Murphy, Mark Maslan, Kenneth Scheinberg and Elton Sunderland knew of Seaboard’s water pollution and narcotrafficing yet went on to provide (perjured) testimony to aid Seaboard’s narcopuppets in their selective prosecution of me. In addition, during the course of the Kangaroo Court proceedings held by the KBHA, on my behalf, Scheinberg, Maslan, Quillen could not, in the course of three days of perjured (Scheinberg and Quillen) testimony…could not quote a single English language scientific reference to support their various contentions re:sinus and nasal surgery, intranasal endoscopic examinations, management of obstructive sleep apnea patients, etc. Furthermore, neither Scheinberg nor Maslan took a patient history nor did a physical examination of my surgical patients upon which they offered their scholarly opinions. Repeat!….neither Scheinberg nor Maslan questioned nor examined my surgical patients before offering their opinions! And, now I’ve learned, from reliable sources, that Maslan received over 67,000 dollars for his pitiful two hour performance. How could Maslan and Scheinberg but wonder the ultimate source of these (narco)dollars, having reviewed both of my websites? Furthermore, the presiding officer for this Kangaroo Court, Howard Ellis MD, a Kansas City OBGYN, who specializes in whole body laser hair removal, laser hysterectomies, appetite control prescriptions and commercial real estate (search Howard Ellis MD + laser + hair + real estate),….Ellis denied me my Sixth Amendment Right to confront witnesses (against) me (Carla Stovall, Jenna Rouse, Nichole Leiker, .Vicky Jones, Jane Holt, Kelli Benintendi, Donnie Marshall, Paul Murphy, MD nor any of my surgical patients upon which Scheinberg and Maslan had offered their opinions). And, Ellis would not allow me to call the prosecution’s key witness, Paul Murphy MD, once Murphy’s drug use, prescribing problem and his malpractice (that nearly cost his wife her life) had been discovered. Furthermore, Ellis allowed the obviously perjured testimony of Murphy’s practice partner, Mark Quillen, PHD. “If you thought (Meredith) was an imminent risk to his patients, why did you wait four months to get your report to the KBHA?” And. was rude throughout. And, at one point, shouted at one of my teenage office employees, Jenna Rouse (who Ellis had kept waiting for over five hours re: her testimony), and her father…. within earshot of the court room…”.I’m in charge here …now you get the fuck out of here”…. Exhibit 17 And allowed but five minutes for my closing argument. Ellis denied me a public trial But worse of all…. Ellis denied me a jury trial I contend that these Constitutional violations, by these narcopuppets, were carried out at the direction of puppeteers Carla Stovall and Hillary Clinton. Are there such people? People with no conscience who will do as they are told to protect their own position? Too many. As long as they can rule over some little corner of the world, they will do anything to maintain and keep their power. What is right and wrong doesn't even enter their mind. All that matters is being in a position of power and keeping that power. Clinton is the source of their power. They are loyal to him, not because they believe in a particular cause or ideology, not because he's their buddy, but because without him they will be on the street looking for a real job -- or worse….Playing Clinton's Dangerous Game, David M. How many handgun deaths, drive by shootings, episodes of gang violence, runaways, cases of prostitution, under the influence (auto) accidents, spontaneous abortions, cases of blue baby syndrome, contract murders, HIV and hepatitis C infections and long term, drug related, imprisonments were the result of the tons of cocaine imported into this country by the Clinton pals at Seaboard Farms and (Jackson) Stephens Trucking? And as a result of Seaboards water pollution? How many young lives have been ruined by their corporate greed?
